The               DUI               (Driving               Under               the               Influence)               laws               in               Arizona               2010               are               considered               some               of               the               strictest               in               the               country.

The               penalties               are               harsh,               even               for               a               first               offender.

One               of               the               harsher               penalties               that               distinguish               Arizona               from               other               states               is               the               mandatory               installation               of               an               ignition               interlock               devise               for               first               time               offenders.

The               Motor               Vehicle               Department               requires               the               installation               of               an               ignition               interlock               device               for               a               period               of               twelve               months               for               any               vehicle               operated               by               a               person               convicted               of               DUI               in               Arizona.

In               Arizona               a               person               can               be               convicted               of               a               DUI               if               they               are               found               to               be               impaired               to               the               slightest               degree               by               alcohol,               drugs               or               any               combination               thereof.

This               includes               prescription               medications.

First               Offense               Criminal               Penalties               DUI               2010
               Under               A.R.S.

28-1381(A)(1)               a               person               can               be               convicted               for               DUI               if               they               are               impaired               to               the               slightest               degree               by               alcohol,               drugs               or               any               combination               of               the               two.

Also               under               A.R.S.

28-1381(A)(2)               a               BAC               (Blood               Alcohol               Concentration)               of               .08               to               .149               is               considered               as               driving               under               the               influence.

The               criminal               penalties               for               either               of               the               above               are               a               sentence               of               one               day               to               six               months               in               jail.

The               fines               range               from               $250               to               $2,500               plus               surcharges               and               assessments               of               up               to               $1,000.

The               court               will               demand               alcohol               screening               and               treatment.

Additionally,               the               court               can               issue               an               order               for               jail               costs               and               community               service.
               First               Offense               Department               of               Motor               Vehicle               Penalties               2010
               The               Motor               Vehicle               Department               will               impose               a               90-day               driver's               license               suspension               if               you               are               convicted               of               a               DUI               in               Arizona.

In               addition               eight               points               will               be               added               to               your               driver's               license               record.

The               Motor               Vehicle               Department               will               require               the               installation               of               an               ignition               interlock               device               for               a               period               of               12               months.
               First               Offense               Extreme               DUI               Criminal               Penalties               2010
               A               blood               alcohol               content               of               .149               to               .199               is               considered               an               Extreme               DUI               under               Arizona               law               28-1382(A)(1).

If               you               are               convicted               of               an               extreme               DUI               in               Arizona               you               will               face               a               minimum               jail               sentence               of               30               days               to               six               months.

The               fines               range               from               $250               to               $2,500               plus               costs               and               83               percent               surcharges               of               $2,250.
               First               Offense               Extreme               DUI               Department               of               Motor               Vehicle               Penalties               2010
               The               Department               of               Motor               Vehicles               will               add               eight               points               to               your               driving               record               and               suspend               your               driver's               license               for               90               days.

In               addition               the               installation               of               a               certified               ignition               interlock               devise               is               required               for               a               period               of               12               months.
               First               Offense               Super               Extreme               DUI               2010
               In               Arizona               a               BAC               of               .20               or               above               is               considered               a               Super               Extreme               DUI.

A               conviction               for               Super               Extreme               DUI               will               result               in               a               minimum               jail               sentence               of               45               days               to               six               months.

The               court               will               impose               fines               of               $450               to               $2500.

In               addition               to               surcharges               and               assessments               of               $2,250.
               First               Offense               Super               Extreme               DUI               Department               of               Motor               Vehicle               Penalties               2010
               If               you               are               convicted               for               a               Super               Extreme               DUI               the               Department               of               Motor               Vehicles               will               suspend               your               driver's               license               for               90               days               and               add               eight               points               to               your               record.

The               installation               of               a               certified               ignition               interlock               devise               is               mandatory               for               12               months.
               In               Arizona               a               conviction               for               DUI               is               a               serious               matter.

The               penalties               include               jail               time               and               the               mandatory               installation               of               an               ignition               interlock               devise               even               for               a               first               offender.
